Summary:

The accused pleaded guilty to theft and was sentenced to 18 months conditional and two years' probation. The Crown appealed the sentence.

The Yukon Court of Appeal allowed the appeal.

Criminal Law - Topic 5854

Sentence - Theft - The accused, as head cashier at a food store, misappropriated approxi­mately $212,000 from her employer - 277 separate acts of theft over approxi­mately 3.5 years (approximately $750 per incident) - Threatened viability of business - Pleaded guilty to theft, but made unsuc­cessful efforts to have the plea withdrawn -Absence of remorse - Breach of trust - Pattern of theft was increasing - Planned and persistent conduct - Three months presentence custody - She and her now-estranged husband spent all the funds - No possibility of restitution - The Yukon Court of Appeal held that the sentencing judge erred in the circumstances by im­posing an 18 month conditional sentence, and substi­tuted a custodial sentence of 14 months - Further, the court struck out a probation order of two years.
