Summary:

The accused was convicted of fishing without a licence, contrary to s. 5(1) of the Northwest Territories Fishery Regulations. The accused appealed.

The Northwest Territories Supreme Court allowed the appeal and acquitted the accused, holding that the accused was entitled to the same exemption from obtaining a licence that was given to Indians, Inuk and persons of mixed blood under s. 22 of the Regulations. The court held that the failure to give the accused the same exemption would violate his right to "equality before the law" under s. 1(b) of the Canadian Bill of Rights. The Crown appealed.

The Northwest Territories Court of Appeal allowed the appeal and restored the conviction. The court held that s. 22 did discriminate between one group of citizens and another, but that it was permissible where done for a "valid federal objective".
