Summary:

The accused pled guilty to two charges of theft and two charges of breach of probation. A joint submission was made for 60 days, followed by another year of probation.

The Newfoundland and Labrador Provincial Court imposed a sentence of 60 days, less five days credit for three days time served in custody, followed by probation for 12 months. Mandatory victim surcharges totalling $400 were to be paid within 30 days.

Sentence - Theft - On February 24, 2015, the accused fuelled up at Lake's Auto station and left without paying for the gasoline - On March 1, 2015, the accused took two cases of beer from a store without paying - The accused pled guilty to two charges of theft and two charges of breach of probation - Prior criminal record - A joint submission was made for 60 days, followed by another year of probation - The Newfoundland and Labrador Provincial Court imposed a sentence of 60 days, less five days credit for three days time served in custody, followed by probation for 12 months - Mandatory victim surcharges totalling $400 were to be paid within 30 days - The court stated, inter alia, that "In this jurisdiction, trial judges are expected to endorse joint submissions: ... Of necessity, this will sometimes require that the principled approach to sentence give way to the expediency of endorsing the joint submission. This is such a case".
