Summary:

The accused was convicted of aggravated assault and assault with a weapon (a rock contained in a sock). He also pleaded guilty to mischief to property owned by the RCMP (telephones) and three breaches of a recognizance, all of which were committed while he was on bail for the assault offence.

The British Columbia Provincial Court determined the appropriate sentence, which included two years less a day and three years' probation for the assault offences. The court also imposed firearms and weapons prohibitions and made a DNA order. The accused applied for leave to appeal, and if leave was granted, appealed the sentence for the assault offences, requesting a three year suspended sentence and probation or, alternatively, a reduction of the jail term.

The British Columbia Court of Appeal dismissed the appeal.
