Summary:
From July 2012 to September 2013, the 43 year old accused had sexual intercourse seven times with a 13 year old girl. At the time, he was bound by a probation order which required that he "keep the peace and be of good behaviour." The accused pleaded guilty to sexual interference and breach of probation (Criminal Code, ss. 151 and 733.1(1)). The Crown proceeded by way of indictment in relation to each charge.
The Newfoundland and Labrador Provincial Court sentenced the accused to four years' imprisonment for sexual interference and four months consecutive for breach of probation. The court also imposed the following ancillary orders: a lifetime Sex Offender Information Registration Act order; a lifetime s. 161 prohibition regarding contact with children under age 16; a DNA order (primary); a s. 109 weapon/ammunition prohibition; and waiver of the victim fine surcharges.

Punishments (sentence) - Prohibition orders - Respecting contact with children - From July 2012 to September 2013, the 43 year old accused had sexual intercourse seven times with a 13 year old girl (LM) - At the time, he was bound by a probation order which required that he "keep the peace and be of good behaviour." - The accused pleaded guilty to sexual interference and breach of probation - The Newfoundland and Labrador Provincial Court imposed, inter alia, a prohibition order under s. 161 of Criminal Code regarding contact with children under age 16 - While the order might affect the accused's ongoing child access litigation, that was a matter for a different forum and a s. 161 order could be varied - The court imposed the prohibition for life because of the nature of the accused's offence; his comment that he "enjoyed" having sexual intercourse with LM; his failure to participate in any programming; and his two previous sexual assault convictions - See paragraph 137.

Sentencing - General - Consecutive sentences - Reduced total term (totality principle) - The Newfoundland and Labrador Provincial Court stated that "Much judicial and academic ink has been spilled in an attempt to explain the sentencing principles of totality and proportionality. Simply put, the proportionality principle of sentencing demands that any sentence imposed be proportionate to the circumstances of the offence and the degree of responsibility of the offender ... . A sentence which is either too lenient or excessive will infringe this principle of sentencing. The totality principle is simply a means of ensuring that when the offender has committed multiple offences, the total sentence imposed is proportionate to the overall criminal conduct committed. The totality principle constitutes the application of the proportionality principle to multiple offences." - See paragraph 119.

Sentencing - Considerations on imposing sentence - Sexual offences against children - From July 2012 to September 2013, the 43 year old accused had sexual intercourse seven times with a 13 year old girl - At the time, he was bound by a probation order which required that he "keep the peace and be of good behaviour." - The accused pleaded guilty to sexual interference and breach of probation - The Crown proceeded by way of indictment in relation to each charge - The Newfoundland and Labrador Provincial Court considered the effect of the increased minimum prescribed periods of imprisonment (statutory ranges) in relation to sexual offences against children, as well as numerous sentencing precedents for both offences - The court considered that the accused used LM's friendship with his step-daughter to initiate contact for sexual purposes and the activity only stopped because LM ended it - Further, the accused and LM had exchanged sexual images - The accused had shown little remorse and no insight into the nature of the relationship with LM and his responsibility as the adult - The accused's criminal record included two previous sexual assault convictions - His prospects for rehabilitation were slim - The only significant mitigating factor was his early guilty plea - The court sentenced the accused to four years' imprisonment for sexual interference and four months consecutive for breach of probation, before granting credit for time served - See paragraphs 1 to 122.
