Summary:

The accused was charged with the first degree murder. He was to be tried by judge and jury. The accused applied for an order that he did not have to appear in visible restraints. Another issue arose regarding an article in a newspaper about the accused's trial. The article contained serious factual errors, violated a publication ban and referred to particulars that were not in evidence. The newspaper was requested to show cause why a contempt order should not issue.

The Ontario Court (General Division) determined how restraints were to be used with respect to the accused. The court found the newspaper in contempt of court. However, the court held that the newspaper's explanation purged the contempt.
