Summary:

The 32 year old accused was speaking with a person when he was interrupted by the victim. The accused told the victim to shut up and punched him in the face. The accused pleaded guilty to a summary conviction charge of assault.

The Newfoundland and Labrador Provincial Court imposed a conditional discharge with three months' probation.

Sentence - Assault (incl. common) - The 32 year old accused was speaking with a person outside of a bar when he was interrupted by the victim - The accused told the victim to shut up and punched him in the face - The accused pleaded guilty to a summary conviction charge of assault - The accused had no prior record, had positive prospects for rehabilitation and the offence was isolated - The accused was in a stable relationship and had a young daughter - The accused and his partner ran several businesses, one of which required the accused to travel outside Canada - The Crown sought a $500 to $700 fine plus probation - The accused sought a conditional discharge in lieu of a conviction - The Newfoundland and Labrador Provincial Court imposed a conditional discharge with three months' probation - A discharge was in the accused's interests and not contrary to the public interest - Conditions included, inter alia, a written apology to the victim, 10 hours of community service and a $1,000 donation to a food bank.
