The accused pled guilty to 46 counts, including several counts each of making child pornography, making available child pornography, possession of child pornography, sexual interference, invitation to sexual touching, sexual exploitation, child luring, sexual assault and extortion.

The New Brunswick Provincial Court, in a decision reported (2013), 411 N.B.R.(2d) 305; 1069 A.P.R. 305, sentenced the accused to 18 years' imprisonment, less pre-trial custody credit (enhanced at 1.5:1), and several ancillary orders. The accused applied for leave to appeal. The Crown cross-appealed.

The New Brunswick Court of Appeal granted leave to appeal, but dismissed the appeal. The cross-appeal was also dismissed.

Smith (Sask. C.A. 2008) to conclude that parole ineligibility was not permissible in a case where a global sentence was imposed unless all of the offences qualified for an order deferring full parole - The New Brunswick Court of Appeal disagreed with that interpretation of R. v.
