Rights of accused - Right to make full answer and defence - Tobin was convicted of refusing to take a breathalyzer test, contrary to the Criminal Code, s. 253(3) - He appealed, arguing that the failure of the Crown to produce police officer's notes from the night of the incident denied him of his right to make a full answer and defence - The notes were not produced because they were lost - However, a prosecution report was disclosed - The officer used his notes to prepare the report - The Nova Scotia Supreme Court dismissed the appeal where Tobin "failed to establish on a balance of probabilities that the loss of the notes affected the fairness of his trial".
