Summary:

The accused was convicted by a jury of dangerous driving causing death. The accused was street racing at the time of the offence.

The Manitoba Court of Queen's Bench sentenced the accused to 22.5 months' in jail and imposed a five year driving prohibition.

Punishments (sentence) - Conditional sentence - When available or appropriate - The accused was convicted by a jury of dangerous driving causing death - The accused was street racing at 11:30 p.m. on a Sunday night on the main thoroughfare in Winnipeg when his car struck the victim's car - The accused was 24 years old - Single - Grade 9 education - Steadily employed as a shift supervisor at Wendy's - Several letters of support from employer, family and neighbours - Expressed genuine remorse - Experienced nightmares from the incident - Prior unrelated criminal record - Two prior speeding tickets - Unlikely to re-offend - The Manitoba Court of Queen's Bench sentenced the accused to two years less a day in jail and gave double credit for 20 days spent in custody for a total sentence of 22.5 months - A penitentiary sentence was not called for, particularly given the accused's very limited related record and his good behaviour since the offence - The accused's street racing was a very significant aggravating factor - The principles of denunciation and general deterrence could not be met by a conditional sentence here - Street racing on busy city streets was an activity which had to be loudly denounced - The accused took a deliberate risk, with tragic consequences, and his sentence had to reflect that - Given the significant degree of the accused's moral blameworthiness, the sentencing principle of retribution supported the court's decision that a conditional sentence was not appropriate - The court also imposed a five year driving prohibition.
