Criminal Law - Topic 253
Abuse of process - What constitutes oppressive or other conduct by the Crown constituting an abuse of process - At the opening of a criminal trial the Crown requested an adjournment because a witness was not available - The counsel for the accused objected to an adjournment - Before the judge ruled on the request for the adjournment the Crown counsel directed the entry of a stay of proceedings pursuant to s. 508(1) of the Criminal Code (see paragraph 17) - A few days later the Crown recommenced proceedings pursuant to s. 508(2)(see paragraph 2) - The accused made a motion for a stay of proceedings on the ground that the Crown's conduct constituted an abuse of process - The Alberta District Court dismissed the accused's motion - The District Court stated that the discretion given to the Crown by s. 508 of the Criminal Code cannot by abridged by the courts. See also the recent decision of the Supreme Court of Canada in the case of R. v. Rourke, 16 N.R. 181.
