Summary:

The accused was charged with having care and control of a motor vehicle while having an excessive blood-alcohol content and while impaired.

The Saskatchewan Provincial Court acquitted the accused on both counts.

Motor vehicles - Impaired driving - Care and control - What constitutes - The accused's car went out of control and into a ditch, where it became so severely stuck in snow that it was completely immobilized - The car doors would not budge open - The accused left the car running to keep warm and while waiting for help, drank rye and eventually passed out - The Saskatchewan Provincial Court held that the accused's purpose in occupying the driver's seat while the car was immobilized was not to set the vehicle in motion and therefore acquitted the accused on charges involving care and control.
