Summary:
Rackley and Sauriol committed an armed robbery. They were later apprehended by certain police officers. Both were shot during the arrest. Rackley and Sauriol sued the officers for damages on the ground they used excessive force. The police officers applied under s. 14 of the Public Authorities Protection Act for security for costs on the ground that Rackley and Sauriol were impecunious. A Master of the court granted the application. Rackley and Sauriol appealed. The appeal court set aside the Master's order. The police officers appealed.
The Ontario Divisional Court dismissed the appeal.

Costs - Security for costs - General principles - Where authorized by statute - Rackley and Sauriol (R&S) were shot while being arrested following an armed robbery - R&S sued the police officers for damages on the ground the officers used excessive force - The officers applied under s. 14 of the Public Authorities Protection Act, R.S.O. 1980, c. 406, for security for costs on the grounds that R&S were impecunious (and incarcerated) and because the officers had a good defence - R&S submitted that they should not be deprived of their right to sue because of their impecunious state - Also, it was not clear that their action was almost certain to fail - The Ontario Divisional Court declined to order security for costs.
