Summary:

The plaintiff employee brought an action for damages against her employer for wrongful dismissal.

The Alberta Provincial Court allowed the action and awarded her $4,000 in lieu of reasonable notice, being the monetary limit of the court's jurisdiction.

Dismissal of employees - Grounds - Wilful disobedience or insubordination - The manager of one retail store in a na­tional chain had her staff "work off the clock" (i.e., staff working before they punched into the time clock, working after they punched out or altering time records) - Although the practice was contrary to known company policy and the Employ­ment Standards Code, the practice was going on with impunity by some managers and the policy was not enforced by the company - On August 10, 1993, following a company crackdown against "working off the clock", the manager was advised to discontinue the practice, which she im­mediately did - On August 23, 1993, without prior warning or an opportunity to respond, the manager was summarily dismissed - The Alberta Provincial Court held that the manager was wrongfully dismissed - There was no evidence of dishonesty, lack of trustworthiness or undermining of the employer's confidence - See paragraphs 1 to 14.

Dismissal without cause - Notice of dis­missal - Reasonable notice - What consti­tutes - A 35 year old manager of a retail store in a national chain was dismissed without cause after 1.66 years' employment - At the time, she earned total remuner­ation of approximately $3,000 per month - She found comparable employment two months later - The Alberta Provincial Court stated that the manager was entitled to 1.5 months' pay in lieu of reasonable notice - The court awarded her $4,000, being the monetary limit of the court's jurisdiction - See paragraph 15.
