Summary:
The plaintiff sued the defendants for negligence. A jury trial ensued. The defendants applied for a nonsuit at the close of the plaintiff's case.
The Saskatchewan Court of Queen's Bench, in a decision reported at [1999] Sask.R. Uned. 11, allowed the motion. The plaintiff appealed.
The Saskatchewan Court of Appeal, in a decision reported at 189 Sask.R. 122; 216 W.A.C. 122, allowed the appeal and ordered a new trial. Issues arose pertaining to costs.
The Saskatchewan Court of Appeal ordered the defendant to pay the plaintiff's costs of the appeal and costs thrown away by reason of the abortive trial, in any event. However, the costs were not payable until after the results of the second trial were known so that, if the defendant was successful, a set-off could take place.
