Summary:

Detective Robertson applied for judicial review, seeking to quash police disciplinary proceedings brought against him by the Chief of Police of the Edmonton Police Service. Robertson alleged that the proceedings were tainted with bias and were launched against him for collateral purposes not permitted by the Police Service Regulation.

The Alberta Court of Queen's Bench dismissed the application.

Natural justice - Constitution of board or tribunal (considerations incl. bias) - Bias - Institutional or systemic bias - Detective Robertson applied for judicial review, seeking to quash police disciplinary proceedings brought against him by the Chief of Police of the Edmonton Police Service - Robertson alleged that the proceedings were tainted with institutional or structural bias because of the extensive involvement of the Chief in the disciplinary process under the scheme of the Police Act and Police Service Regulation and because of the role of the presiding and presenting officers - For example, the chief of police could initiate the complaint, as he did in this case - The Chief decided whether the complaint was serious enough to justify a hearing and then appointed the presiding officer - The presiding officer could consult with the chief of police about the appropriate punishment - The Alberta Court of Queen's Bench held that the scheme was authorized by the Legislature and thus did not create a "bias" recognized by law as long as the scheme survived constitutional challenge - See paragraphs 66 to 72.

Judicial review - General - The Alberta Court of Queen's Bench stated that there are some restrictions on the availability of common law judicial review remedies - The court stated that "... statutes prevail over the common law. Where the statute sets out a particular procedure, compliance with that procedure is adequate even if it is different or lower than the common law standard or procedure. If the statute sets up a structure that the common law would find gives a reasonable appearance of bias, or what the common law would call 'institutional bias', again the statute will prevail over the common law rule. While the general principle is that the statute overrides the common law, there are a number of provisos. The one is of course that the legislation cannot prevail if it is inconsistent with the Charter. However, if the statute survives Charter scrutiny, then it will prevail over the common law. The second proviso is that 'actual bias' is almost always a disqualifying factor. This is simply because statutes very rarely authorize a tribunal with actual bias to proceed with the hearing, and it would be unusual for the court to infer this power ... There are a limited number of cases where the doctrine of necessity requires the tribunal to proceed even if biased, but these are unusual" - See paragraph 40.

Liberty - Charter of Rights and Freedoms - Denial of liberty - What constitutes - Detective Robertson applied to quash police disciplinary proceedings instituted by the Chief the Edmonton Police Service - Robertson argued that any disciplinary proceeding designed to rule on his whistle-blower defence had to be in accordance with the fundamental principles of justice, and if it was not it was unconstitutional - He argued further that certain aspects of the Police Service Regulation were not in accordance with those fundamental principles - Robertson claimed that the "whistle-blower" defence was an aspect of his freedom of expression right, protected by s. 2(b) of the Charter, and that right was a part, or was protected as a part of, the liberty interest in s. 7 - The Alberta Court of Queen's Bench rejected this argument - The case law did not support including the freedom of expression and the other s. 2 rights in the liberty interest (i.e., they were distinct rights) - In any event, the scheme in the Regulation as a whole did not offend the principles of fundamental justice - Further, it was an abuse of process for Robertson to argue the "liberty" issue at this point, when he argued the "security of the person" issue before the case management judge - He could have raised all s. 7 issues then - See paragraphs 23 to 35.

Freedom of speech or expression - Limitations on - Public hearings - Right to - The Chief of Police of the Edmonton Police Service acting under s. 16 of the Police Service Regulation under the Police Act, ordered that discipline proceedings involving Detective Robertson to be held in private - Robertson applied for judicial review, arguing that s. 16 was contrary to the Charter, or alternatively that the Chief's decision to order that the hearing be in camera was not made in a manner consistent with Charter values - The Alberta Court of Queen's Bench held that s. 16 survived Charter scrutiny (i.e., insofar as s. 16 infringed on the freedom of expression, it was justified in a free and democratic society under s. 1 of the Charter) - Further, the Chief's decision to order the hearing in private disclosed no reviewable error - See paragraphs 192 to 222.
