Summary:

The parties separated in November 1998, after almost 28 years of marriage. They entered into a separation agreement that was incorporated into their March 25, 2003 corollary relief judgment. The husband applied for a variation of spousal support.

The Nova Scotia Supreme Court, in a decision reported at [2009] N.S.R.(2d) Uned. 181, allowed the application. The wife appealed.

The Nova Scotia Court of Appeal allowed the appeal, holding that the trial judge erred in finding that there had been a material change of circumstances in the parties' circumstances as required by s. 17(4.1) of the Divorce Act.
