Summary:
A federal Department of Transport employee retired at age 49. He had the option of taking a deferred annuity payable at age 60 or an annual allowance commencing at age 50. The employee, 11 months after retiring, elected to receive the annual allowance. Contrary to his belief, the annual allowance was not retroactive to his fiftieth birthday, but commenced only when he elected to take the allowance. The employee sued in contract and tort for the amount payable had the allowance been retroactive.
The Federal Court of Canada, Trial Division, allowed the action on the ground that it was negligently misrepresented that the payments were retroactive.

Misrepresentation - Negligent misrepresentation - What constitutes - A civil servant retired before age 50 - He had the option of receiving an annual allowance at age 50 or a deferred annuity commencing at age 60 - He elected to take the annual allowance, but made the election months after his fiftieth birthday - The annual allowance was clearly not retroactive to age 50, but commenced when the election was made - The Federal Court of Canada, Trial Division, held that the civil servant was entitled to the amount payable based on a retroactive application, because it was negligently misrepresented to him that the allowance was retroactive and that he had one year from his retirement to make his election.
