Summary:

The issue in this case concerned whether the proceeds of the sale of the bankrupts' jointly-owned home constituted property of the bankrupts.

The Saskatchewan Court of Queen's Bench held that the proceeds were exempt from distribution to the bankrupts' creditors under s. 47(b) of the Bankruptcy Act.

Property of bankrupt - Exemptions - Property exempt from seizure under provincial laws - Residence - Under s. 47(b) of the Bankruptcy Act, property exempt from execution under provincial laws where the bankrupt resides did not constitute property of the bankrupt - The Saskatchewan Exemptions Act exempted a debtor's residence from execution to the extent of $16,000.00 - The Saskatchewan Court of Queen's Bench held that a bankrupt couple's jointly-owned home was exempt under s. 47(b) and the proceeds from its sale were also exempt where the sale was a "forced" one - See paragraphs 4 to 9.
