Résumé:
The husband had been paying spousal support to the wife since 1993. The amount of support had been increased in 2003. The husband moved to end his spousal support, or, alternatively, to reduce it.
The New Brunswick Court of Queen's Bench, Family Division, in a decision not reported in this series of reports, ordered the rescission of spousal support. The wife appealed.
The New Brunswick Court of Appeal dismissed the appeal.

Divorce - Corollary relief - General - Economic self-sufficiency - The parties separated in February 1993, after a 14-year marriage and two children - The husband started to pay spousal support of $500 monthly, based on his then income of $40,000 to $50,000 per year - The parties divorced in 1996 - After the separation, the husband "made a lot of money" in a corporate business venture - In 2003, spousal support was judicially increased to $2,400 per month - By 2009, the husband had sold his interest in the corporate venture - Any income he had been earning from that corporation had also ceased - He started a new venture, which showed a deficit - During the 1993-2009 period, the wife inherited some $400,000 and became entitled to CPP disability benefits - She now lived in a mortgage-free, rent-free home - The husband also inherited some assets worth approximately $282,000 - He had other assets worth approximately $263,000 - His debts, which included a mortgage, a personal and corporate line of credit, and credit cards, totalled approximately $203,000 - A motion judge ordered that the husband's spousal support payments cease as of May 1, 2009 - There had been a change of circumstances since 2003 and the wife was economically self-sufficient and was no longer entitled to spousal support - The New Brunswick Court of Appeal upheld the decision absent reviewable error - The court agreed that the wife no longer suffered any disadvantage or economic hardship from the marriage - Also, the motion judge made no error in assessing the parties' means, which included their capital, and needs - See paragraphs 1 to 39.
