Practice - Topic 9816
Discontinuance - Circumstances when plaintiff cannot discontinue - The plaintiff sued the defendants, alleging fraud and oppressive conduct with respect to the business of the defendant, Nations Energy Co. Ltd. - Two of the defendants, Nations Energy and Wilson, obtained summary judgment - Several of the other defendants applied for summary judgment on the same grounds - The plaintiff filed a discontinuance of the action - The chambers judge allowed the applications for summary judgment - The plaintiff appealed - The Alberta Court of Appeal dismissed the appeal - While the plaintiff had a wide ranging right to discontinue the action, the defendants had an equal right to bring an application for summary dismissal - Just as there were no conditions listed in rule 225 on the right to discontinue, there were no conditions listed in rule 159(2) on the right to seek summary dismissal - The plaintiff filed a discontinuance of action and thereby attempted to deprive the defendants of their right to seek summary dismissal - This was prejudicial to the defendants and abusive of the processes of the court - The chambers judge was correct to proceed in the face of the discontinuance.
