Sierra Club of Canada, a national organization concerned with environmental protection and restoration and a non-profit corporation duly constituted on April 27, 1992, by Letters Patent under the Canadian Corporations Act (applicant) v. the Minister of Finance of Canada, the Minister of Foreign Affairs of Canada, the Minister of International Trade of Canada and the Attorney General of Canada (respondents) and Atomic Energy of Canada (intervenor)

Summary:

The Sierra Club applied for judicial review of the respondent Ministers' decision not to subject the sale of CANDU nuclear reactors to China to an environmental assessment. Atomic Energy of Canada applied to strike out the Sierra Club's application on the ground of lack of standing. The Associate Senior Prothonotary dismissed the motion to strike. Atomic Energy and the Ministers moved to appeal the decision.

The Federal Court of Canada, Trial Divi­sion, dismissed the motion.
