Simon and others brought an application for an interlocutory injunction that would prohibit the government of New Brunswick from entering into forest management agreements with the intended respondent companies.

The New Brunswick Court of Queen's Bench, Trial Division, in an unreported decision, dismissed the application. Simon et al. moved for leave to appeal.

The New Brunswick Court of Appeal, per Larlee, J.A., dismissed the motion.

Appeals - Leave to appeal - From interlocutory ruling - Simon and others brought an application for an interlocutory injunction that would prohibit the government of New Brunswick from entering into forest management agreements with the intended respondent companies - The application judge dismissed the application - Although Simon et al. had established that there was a serious issue to be tried, they had not established they would suffer irreparable harm if the injunction was not granted and the balance of convenience did not favour granting the injunction - Simon et al. moved for leave to appeal - The New Brunswick Court of Appeal, per Larlee, J.A., dismissed the motion - In considering whether or not to grant leave to appeal, the court considered the following criteria: (1) whether there was a conflicting decision by another court upon a question involved in the proposed appeal; (2) whether the court doubted the correctness of the decision; and (3) whether the court considered that the proposed appeal involved matters of sufficient importance - The court was not aware of any conflicting decisions upon a question involved in the proposed appeal - The court concluded that the application judge's decision was correct - Finally, the court did not consider the nature of the appeal to involve such matters that leave to appeal should be granted - Even if one of the criteria had been met, the court would have exercised its residual discretion to deny leave - The application for an injunction was premature - Since there was no underlying action commenced, there was an absence of context and details regarding the alleged breach of the duty to consult.
