Summary:

In October 2012, Staetter was found not criminally responsible by reason of mental disorder on charges of uttering threats, uttering threats to cause death or bodily harm and criminal harassment. The British Columbia Review Board determined that a custodial disposition was necessary and appropriate taking into account the paramount consideration of public safety, Staetter's mental condition, and his reintegration into society and other needs. Staetter appealed the Review Board's September 2015 decision that he remain in custody.

The British Columbia Court of Appeal dismissed the appeal. The Review Board's conclusion that Staetter's continued detention was necessary was a reasonable one supported by the evidence.
