The Primary Sources of
Canadian Law
The fundamental sources of legal research are statutes, regulations, bylaws, and case
law. Statutes are created by Parliament and the provincial legislatures; regulations are
created by government departments; bylaws are created by municipalities under a
delegated legislative power from the province; and case law is created by judges and
adjudicators to explain their reasons for making a decision after hearing a case. A client
who needs legal advice may be affected by one or more of these kinds of law. When
you know what law governs the client’s problem, you begin to know what can be
done and what choices to give the client about how to proceed.
