Reception of English law - Ouster of, by Canadian legislation - The defendant pleaded guilty to a charge of common assault under s. 245(1) of the Criminal Code of Canada and was fined $25.00 - A civil action by the plaintiff arose out of the same incident - The defendant applied by notice of motion for an order dismissing the plaintiff's action, contending that it was barred by the provisions of the Offences Against the Person Act, 1861 (Imp.), 24 & 25 Vict., c. 100, and that such act was still part of the law of the Province of Saskatchewan - The Saskatchewan Court of Queen's Bench held that the Offences Against the Person Act was not in force in Saskatchewan and dismissed the defendant's application with costs to the plaintiff - The court stated that once the Parliament of Canada or a provincial legislature has validly occupied a field covered by Imperial legislation, the Imperial statute is ousted and a subsequent repeal of the Canadian legislation cannot revive the Imperial legislation it displaced - See paragraphs 2 to 11.
