Résumé:
The defendant gave the plaintiff and two other friends a ride home in his father's car after a party. They went to the defendant's home and had a lunch. They then left and drove one of the friends home. The next stop was to be at the plaintiff's home but the defendant failed to stop at an intersection and collided with another vehicle. The plaintiff sustained injuries. The plaintiff brought an action in negligence against the defendant driver and the owner of the vehicle.
The New Brunswick Court of Queen's Bench, Trial Division, in a decision reported in 70 N.B.R.(2d) 183; 179 A.P.R. 183, allowed the action. The court held that the driver was negligent and that at the time he was driving the car with the implied consent of the owner. The court held the defendant driver 60% at fault. The court found the plaintiff 40% at fault, because the plaintiff had initiated the problem by asking for a ride home while being aware of the defendant's driving performance and because he had two clear opportunities to separate himself from the potential danger. The defendant owner of the vehicle appealed on the issue of whether the defendant driver was operating the vehicle with his implied consent.
The New Brunswick Court of Appeal dismissed the appeal.
