New Brunswick Court of Appeal

Stratton, C.J.N.B, Rice and Ryan, JJ.A.

December 1, 1986.

Summary:

Résumé:

The defendant gave the plaintiff and two other friends a ride home in his father's car after a party. They went to the defendant's home and had a lunch. They then left and drove one of the friends home. The next stop was to be at the plaintiff's home but the defendant failed to stop at an intersection and collided with another vehicle. The plaintiff sustained injuries. The plaintiff brought an action in negligence against the defendant driver and the owner of the vehicle.

The New Brunswick Court of Queen's Bench, Trial Division, in a decision reported in 70 N.B.R.(2d) 183; 179 A.P.R. 183, allowed the action. The court held that the driver was negligent and that at the time he was driving the car with the implied consent of the owner. The court held the defendant driver 60% at fault. The court found the plaintiff 40% at fault, because the plaintiff had initiated the problem by asking for a ride home while being aware of the defendant's driving performance and because he had two clear opportunities to separate himself from the potential danger. The defendant owner of the vehicle appealed on the issue of whether the defendant driver was operating the vehicle with his implied consent.

The New Brunswick Court of Appeal dismissed the appeal.

Torts - Topic 309

Negligence - Motor vehicle - Liability of owner for negligence of driver of owner's vehicle - Consent - What constitutes - A father regularly permitted his son to drive his car - The son asked if he could use the car for a weekend trip - The father said he would think about it, but later refused permission - The son took the car, went to a party and later gave the plaintiff a ride home - There was an accident - The New Brunswick Court of Queen's Bench, Trial Division, held that the son was operating the vehicle with the implied consent of his father - The court was satisfied that permission had been denied for the weekend trip but that the father's general consent to the son's use of the car had not been revoked - The New Brunswick Court of Appeal refused to disturb the judge's finding on consent.
