Summary:

A bank sued on a mortgage covenant for the deficiency owed to it after default and sale of the mortgaged property. At issue was whether the defences of non est factum and breach of fiduciary duty could be accepted as evidence and whether the bank acted negligently on the sale of the mortgaged property, and if so, the consequences of such negligence to the bank's claim.

The Ontario Court (General Division) granted the bank judgment, rejecting the pleas of non est factum and breach of fiduciary duty and holding that the bank had not acted negligently.
