Summary:
The City of Toronto obtained a building permit to construct a community centre in Eglinton Park. A nonprofit corporation, Friends of Toronto Parkland, appealed the granting of the building permit under s. 15 of the Building Code Act. The City applied for a ruling that the Friends lacked status to launch the appeal. The motions judge allowed the City's application, holding that Friends was not a "person who considered himself aggrieved" within the meaning of s. 15(1) of the Act. The Friends appealed under s. 16 of the Act.
The Ontario Divisional Court dismissed the appeal.

Land use control - Building permits - Appeals to appeal board - Persons with status to appeal - The Building Code Act, s. 15(1), permitted "any person who considers himself aggrieved by an order given or decision made by an inspector or chief official under this Act" to appeal within 20 days - The Ontario Divisional Court held that the approach to be taken in determining who are persons who "consider" themselves aggrieved, is to ask whether the person "reasonably" considers himself aggrieved - See paragraphs 49, 50.
