Summary:

The City of Toronto obtained a building permit to construct a community centre in Eglinton Park. A nonprofit corporation, Friends of Toronto Parkland, appealed the granting of the building permit under s. 15 of the Building Code Act. The City applied for a ruling that the Friends lacked status to launch the appeal. The motions judge allowed the City's application, holding that Friends was not a "person who con­sidered himself aggrieved" within the mean­ing of s. 15(1) of the Act. The Friends appealed under s. 16 of the Act.

The Ontario Divisional Court dismissed the appeal.

Land use control - Building permits - Appeals to appeal board - Persons with status to appeal - The Building Code Act, s. 15(1), permitted "any person who con­siders himself aggrieved by an order given or decision made by an inspector or chief official under this Act" to appeal within 20 days - The Ontario Divisional Court held that the approach to be taken in determin­ing who are persons who "consider" them­selves aggrieved, is to ask whether the per­son "reasonably" considers himself aggrieved - See paragraphs 49, 50.

Land use control - Building permits - Appeals to appeal board - Persons with status to appeal - Toronto obtained a building permit for a community centre in a local park - Friends of Toronto Park­land, a nonprofit corporation, consisting of 63 members, appealed the granting of the permit under s. 15(1) of the Building Code Act - Section 15(1) gave a right of appeal to "any person who considers himself aggrieved" by the granting of a permit etc. - Members of the Friends group lived in Toronto, some near the park - The Ontario Divisional Court affirmed that the Friends lacked status to appeal under s. 15(1).
