Chapter 32 Transfers

CHAPTER 32

is chapter discusses transfers of land and their role in conveying ownership of real

property and also includes illustrated guidance on the electronic preparation and registration

of transfers.

WHAT IS A TRANSFER

Title to real property transfers when real property changes hands; hence, transfer is the name

of the document which accomplishes a transfer of title to a new owner. A transfer is commonly

referred to as a deed or a transfer/deed, and we use transfer or transfer/deed interchangeably.

Pursuant to the Land Registration Reform Act, however, the document which transfers title is a

transfer.

ELECTRONIC TRANSFER

Pursuant to the Land Registration Reform Act, electronic registration is in force in all parts of the

province. Electronic registration, e-reg for short, is accomplished through the Teraview software

by Teranet Inc., which is a government-approved software. Although the format of the e-reg

transfer diers from that of the paper transfer/deed, Form 1, the substance of the information

is the same for both forms. In both documents, the parties are referred to as transferor for the

party selling, and transferee for the party buying. e lawyer for the vendor (transferor) usually

prepares the transfer/deed (electronic or paper).

PREPARING THE ELECTRONIC TRANSFER

e following e-reg instructions assume that you are familiar with the Teraview e-reg software

through either the law oce or the Teraview Training System tutorial at your college. As a begin-

ner in this chapter’s introductory e-reg transfer, you may wish to use Precedent 32.1 for visual

support and prepare that same transfer by applying the guided Teraview steps which follow and

which relate to the same transfer. When done, your completed e-reg transfer should be the same

as that in Precedent 32.1.

view.ca in your oce or www.teraviewtraining.ca in the Teraview Training System at your college.
