TRANSPORTATION LAW
This topic deals with the law as it relates to various modes of transportation (excluding aviation
law, maritime law, and motor vehicle law, which are dealt with separately). Topics include car-
riage of goods and passengers, railways, and trucking, etc. As most transportation in Canada
is interprovincial, this is an area of primarily federal jurisdiction, governed by various federal
statutes, (e.g., the Canada Transportation Act, the Department of Transport Act, the Aeronautics
Act, and the Railway Safety Act). There are, however, some provincial statutes governing trans-
portation exclusively within their borders. A number of provinces have railway acts and most
have legislation dealing with the transportation of hazardous goods (as does the federal gov-
ernment by virtue of the Hazardous Products Act). Related topics: AVIATION & AERONAUT-

Domaine très réglementé autant que peu documenté. À part le fait que le contrat de transport
est un des contrats nommés, la complexité du droit des transports tient à la fois du droit
CONSTITUTIONNEL (par ex., transport local vs interprovincial et international, ce dernier
étant régi par les conventions) et aux divers moyens de transport (par ex., aérien, maritime, ter-
restre). Outre la réglementation étatique applicable, il faut tenir compte de l’apport des parties
au contrat, et ce, particulièrement en droit COMMERCIAL INTERNATIONAL.
