TRUSTS

The law of trusts is a very old and complicated area of property law that originated centuries

ago in England. At its core is the notion that property can be held by one party (the trustee) for

the benef‌it of another person, either the party entrusting the property to the trustee (known

as the benef‌iciary) or even for a third party. The trustee must always deal with the property in

the best interests of the benef‌iciary. Trusts can be express or implied (i.e., inferred by a court).
