Summary:

An employee was dismissed from his employment with the defendant company. The union launched a grievance. An arbitrator reinstated the employee with a disciplinary suspension and a disciplinary transfer to a different position within the company for a period of one year. The union objected to the employee's name being published in the arbitrator's award and argued that it should be initialized. The union submitted that the Personal Information Protection Act (PIPA) precluded arbitrators from including the personal information of grievors or witnesses in arbitration awards without the express consent of those individuals. The arbitrator rejected this argument. The Labour Relations Board upheld the arbitrator's decision. The union appealed.

The British Columbia Court of Appeal dismissed the appeal. The disclosure of personal information without consent was "authorized by law" under s. 18(1)(o) of the PIPA. Section 96 of the Labour Relations Code required disclosure of an award to the director of the Arbitration Bureau.
