Summary:
The applicant applied for judicial interim release pending a decision by the Minister of Justice whether to surrender him to the United States under the Extradition Act to face murder and theft charges. The Attorney General of Canada argued that there was no basis on which to grant bail because the applicant had not indicated the basis on which he intended to persuade the Minister not to order his surrender; that he was a flight risk; and that his release would not be in the public interest.
The British Columbia Supreme Court, per Kirkpatrick, J.A., dismissed the bail application.
