Summary:
Vriend et al. challenged the constitutional validity of ss. 2(1), 3, 4, 7(1), 8(1) and 10 of the Individual's Rights Protection Act (Alta.) under s. 15 of the Charter. Vriend et al. alleged that the impugned sections of the Act were discriminatory and infringed s. 15 of the Charter because they did not include sexual orientation as a proscribed ground of discrimination.
The Alberta Court of Queen's Bench declared that the impugned provisions were inconsistent with s. 15(1) of the Charter and that the infringement of s. 15(1) was not justified under s. 1 of the Charter. As a remedy, the court held that the sections should be interpreted, applied and administered as though they contained the words "sexual orientation". The court stayed its declaration for 30 days to permit the Crown to consider an appeal.
