Summary:

Prospective adoptive parents applied under s. 58(7) of the Child and Family Services Act to dispense with the natural mother's consent to the adoption.

The Manitoba Court of Queen's Bench, Family Division, allowed the application and ordered that the mother's consent be dis­pensed with.

Adoption - Consent of parents - Dispens­ing with consent - Grounds for - A 23 year old unmarried university student chose to place her new born child for private adoption - She had first consulted social workers, her parents, her pastor and had legal advice - Several months later she withdrew her consent - The adoptive parents applied under s. 58(7) of the Child and Family Services Act to dispense with her consent - The mother sought the return of her child, now 22 months old - The child had bonded with the adoptive parents - The mother had limited contact - All experts agreed that returning the child to the natural mother would not be in the child's best interests, given the evi­dence as to bonding and attachment - The child was sensitive and resistant to change - There was no attachment to the natural mother - The Manitoba Court of Queen's Bench, Family Division, dispensed with the mother's consent to the adoption - It was in the child's best interests to remain with the adoptive parents.
