Summary:
A divorce judgment reserved payment of child support because of the father's inability to pay at that time. The wife obtained an order for interim support. A subsequent interim order reduced the monthly support payment, fixed the arrears owing and ordered retroactive pre-application child maintenance. The husband appealed the retroactive award.
The Alberta Court of Appeal dismissed the appeal.

Maintenance of wives and children - Appeals - General - The Alberta Court of Appeal stated that "[t]he standard of review to be used when considering an appeal in family law cases is one of considerable deference. Appeal courts should not overturn support orders unless there is an error of principle, a clear misapprehension of the evidence, or unless the award is clearly wrong" - See paragraph 8.

Divorce - Corollary relief - Maintenance awards - Retroactive awards - A divorce judgment reserved payment of child support because of the husband's inability to pay - Thereafter, the wife obtained an interim order for retroactive pre-application child maintenance - The husband appealed the retroactive order where there were no exceptional circumstances - The Alberta Court of Appeal dismissed the appeal - The test relied on "appropriate circumstances" not "exceptional circumstances" - The Chambers judge correctly stated that retroactive awards were appropriate when there was "intimidation, intentional non-disclosure or under reporting of income, and knowing that the children are in financial need and ignoring that obligation" - There was ample evidence to support a finding on any one of those factors The Chambers judge applied "practical considerations", being knowledge of the wife's need, the husband's ability to pay, the non-disclosure of income and the wife's fear, to his decision - Although the quantum was arbitrary, the decision to award retroactive support was not.
