A law firm brought a Small Claims Court action against a client to recover fees for legal services. An order issued for $8,356.89. The law firm applied ex parte for an Order for Discovery in Aid of Execution.
An Adjudicator of the Small Claims Court ruled that he had jurisdiction under s. 31(1) of the Small Claims Court Act to compel the client to attend a discovery in aid of execution.

Provincial courts - Nova Scotia - Small Claims Court - Jurisdiction - Adjudicator - Section 31(1) of the Small Claims Court Act provided that "an order of the court may be enforced in the same manner as an order of the Supreme Court and section 45 of the Judicature Act applies" - An Adjudicator of the Small Claims Court held that he had jurisdiction under s. 31(1) to make an Order for Discovery in Aid of Execution - The Small Claims Court, within its statutory limits, had jurisdiction that was concurrent with the Supreme Court - A court order or execution order would be a hollow remedy if no procedure existed to facilitate the enforcement of such orders.
