Summary:

The Federal Court of Canada, Trial Division, on a motion by the plaintiff under Federal Court Rule 474, set a hearing date to determine a preliminary question of law in these proceedings, namely, whether s. 7(b) of the Trade Marks Act was ultra vires the Federal Parliament. The defendant applied for a stay of the hearing pending an appeal. The Federal Court of Canada, Trial Division, dismissed the application for the stay.
