Summary:

The plaintiff claimed for damages for personal injuries arising out of a motor vehicle accident. The Nova Scotia Supreme Court, Trial Division, held the defendant 100 percent at fault and awarded the plaintiff $6,500.00 general damages for personal injuries plus special damages.

Negligence - Motor vehicles - Speed - Circumstances when reduced speed required - The defendant driver lost control of his vehicle on a city street which was icy but was center bare - The defendant admitted travelling slightly in excess of the speed limit of 30 miles per hour - The Nova Scotia Supreme Court, Trial Division, held that the defendant was negligent in driving too fast for the existing conditions (see paragraph 42).

Interest as damages - Negligence, personal injuries - The Nova Scotia Supreme Court, Trial Division, awarded a plaintiff interest at 8 percent per annum for 2 years preceding the date of the judgment where the accident occurred 5 years preceding the date of the judgment but the trial of the action was delayed by the plaintiff's lawyers (see paragraphs 52 to 56).
