North Bay council hopes to avoid a fight in dealing with an Ontario Municipal Board (OMB) appeal over a planning bylaw it unknowingly passed last October.

The Downtown Village Community Development Inc. is taking the city to the OMB because of a bylaw approved in October which could lead to 74,000 square feet of commercial space being developed on McKeown Avenue.
