Summary:
A father applied to reduce his obligation to pay $200/month maintenance for his two children.
The Nova Scotia Family Court allowed the application and suspended the father's maintenance obligation because of his present inability to pay.

Divorce - Corollary relief - Maintenance awards - Jurisdiction of court to grant maintenance - The Nova Scotia Family Court awarded maintenance under provincial legislation - Four months later, the spouses divorced in Ontario - The divorce judgment was silent as to maintenance and the divorce order was not before the court - The Nova Scotia Family Court stated that "decisions indicate that if a provincial legislation support order exists and if a divorce order is silent as to maintenance then the provincial order continues to exist. They also suggest that if a divorce order is silent on maintenance a provincial order may be issued to cover support." - See paragraphs 6 to 7.
