A grade four Nova Scotia boy was playing tackle football at recess with his pals; a game which he knew was prohibited by school rules. He collided with another boy while trying to block a pass and broke his leg. His parents sued the school board, alleging inadequate supervision. Justice Goodfellow of the Nova Scotia Supreme Court dismissed the action. He stated that the board, through the playground supervisor, was required to act as a reasonably careful and prudent parent would under the circumstances. He noted that the playground supervisor was qualified to supervise, that she patrolled the area of the playground regularly and in a circuit, and that she was watching for misconduct and inappropriate or unsafe playground behaviour.
