Frederick Bell was the primary cardholder of a CIBC VISA card. His wife was an authorized user of the same card. After his death, she argued that she was only responsible for the charges on the card that she had personally made and not for her late husband's charges. Justice Sproat of the Ontario Superior Court of Justice agreed. He noted that the provisions accompanying the card made a clear distinction between the obligations of primary cardholders and authorized cardholders. A primary cardholder is "liable for all use of and charges to the VISA account, including use by the Authorized User(s)." The authorized user agrees to be "liable for all charges on my card ..."...
