Digest: The plaintiffs brought a small claims action against the defendants for breach of contract and damages. The defendant farmer asked the plaintiff farmer to cut and bale hay for him on his land and in return, the plaintiff would receive two thirds of the bales produced. The plaintiff cut and baled hay in 2015, 2016 and 2017. In the last year, the plaintiff went to the defendant�s farm to pick up his share of the bales but found that the defendant had improperly retained 41 of them. He sought damages in the amount of $2,250 (41 bales at $55 per bale). The defendant denied owing anything to the plaintiff because the latter had violated their agreement.
