Summary:

Forestell was elected by the University of New Brunswick Student Union to sit on the Board of Governors of the University. Subsequently the Board rendered a decision which purported to vacate Forestell's right to sit as a member of the board. She applied for judicial review.

The New Brunswick Court of Queen's Bench, Trial Division, in a decision reported 84 N.B.R.(2d) 181; 214 A.P.R. 181, dismissed her application, holding that the matter was within the jurisdiction of the Visitor of the University of New Brunswick.

Subsequently the Visitor allowed Forestell's application to set aside the decision of the Board of Governors to remove her from office. The Visitor ordered that she be reinstated as a member of the Board with all the rights and privileges of the position (89 N.B.R.(2d) 1; 226 A.P.R. 1).
