Applications and motions - Motions - When used or applicable - The plaintiff provided the catering services at Marine Atlantic's ferry terminals at Borden and Cape Tormentine - Marine Atlantic took possession of the premises, relying on its right under the contract to cancel by giving 120 days' notice - The plaintiff proposed to sue Marine Atlantic - The plaintiff brought a motion for pretrial relief, name­ly, a declaration of wrongful conduct and an order restraining Marine Atlantic's conduct - The Prince Edward Island Supreme Court, Trial Division, stated that the plaintiff's motion must fail "for the principal reason that it seeks a resolution of the ultimate question by means of an interim declaration" - Furthermore, there was no authority under the Landlord and Tenant Act for granting the interim decla­ration.
