Summary:

A meat company defaulted on a debenture and a general security agreement held by the National Bank. The bank appointed a receiver who liquidated the company. Pursuant to the Employment Standards Act, a referee ordered the receiver to pay, from the proceeds of the liquidation, vacation pay owing to the employees. The bank applied for judicial review of the referee's decision.

The Ontario Divisional Court, Eberle, J., dissenting in part, dismissed the application for judicial review and upheld the decision of the referee.
