Partie III à titre de version officielle depuis le 1er avril 2003

de la Partie II comme média substitut sont disponibles sur

Notice to Readers

The Canada Gazette is published under the authority of

the Statutory Instruments Act. It consists of three parts

as described below:

Part I Material required by federal statute or

regulation to be published in the Canada

Gazette other than items identified for Part II

and Part III below — Published every Saturday

Part II Statutory instruments (regulations) and

other classes of statutory instruments and

documents — Published January 8, 2020, and

at least every second Wednesday thereafter

Part III Public Acts of Parliament and their enactment

proclamations — Published as soon as is

reasonably practicable after royal assent

The two electronic versions of the Canada Gazette are

available free of charge. A Portable Document Format

(PDF) version of Part I, Part II and Part III as an official

version since April 1, 2003, and a HyperText Mark-up

Language (HTML) version of Part I and Part II as an

alternate format are available on the Canada Gazette

l’environnement (1999)]

Attendu que le ministre de l’Environnement et la ministre

de la Santé (les ministres) ont évalué les renseignements

dont ils disposent concernant l’organisme vivant virus

Coxsackie A21, souche Kuykendall;

Attendu que les ministres soupçonnent que l’organisme

vivant est effectivement ou potentiellement toxique au

sens de l’article 64 de la Loi canadienne sur la protection

de l’environnement (1999) [la Loi],

Par les présentes, le ministre de l’Environnement, en

vertu de l’alinéa 109(1)a) de la Loi, autorise la fabrication

ou l’importation de l’organisme vivant aux conditions

énoncées à l’annexe ci-après.

Conditions

[Alinéa109(1)a) de la Loi canadienne sur la protection de

l’environnement (1999)]

1. Les définitions qui suivent s’appliquent aux présentes

conditions ministérielles :

« déchets » s’entend de toute matière solide ou liquide

produite par une installation et destinée à être éliminée, et

peut comprendre des effluents générés par le rinçage de

l’équipement ou des contenants utilisés pour l’organisme

vivant, des contenants jetables utilisés pour l’organisme

vivant, de toute quantité de l’organisme vivant déversée

accidentellement, des effluents des procédés contenant

l’organisme vivant ainsi que de toute quantité résiduelle

de l’organisme vivant sur tout équipement ou dans tout

contenant;

« déclarant » s’entend de la personne qui, le 4 août 2020, a

fourni au ministre de l’Environnement les renseignements

réglementaires concernant l’organisme vivant conformé-

ment au paragraphe 106(1) de la Loi canadienne sur la

protection de l’environnement (1999);

Ministerial condition

(Paragraph109(1)(a) of the Canadian Environmental Protection

Act, 1999)

Whereas the Minister of the Environment and the Minis-

ter of Health (the ministers) have assessed information

pertaining to the living organism Coxsackievirus A21,

Kuykendall strain;

And whereas the ministers suspect that the living organ-

ism is toxic or capable of becoming toxic within the mean-

ing of section 64 of the Canadian Environmental Protec-

tion Act, 1999 (the Act),

The Minister of the Environment, pursuant to para-

graph 109(1)(a) of the Act, hereby permits the manufac-

ture or import of the living organism in accordance with

the conditions of the following annex.

Conditions

(Paragraph109(1)(a) of the Canadian Environmental Protection

Act, 1999)

1. The following definitions apply in these ministerial

conditions:

“Canadian Biosafety Standard” means the document

entitled Canadian Biosafety Standard, 2nd Edition, pub-

lished in 2015, developed by the Public Health Agency of

Canada and the Canadian Food Inspection Agency, as

amended from time to time;

“contained facility” means an enclosed building with

walls, floor and ceiling, or an area within such a building,

where the containment is in accordance with the physical

and operational requirements of a level set out in either

the Canadian Biosafety Standard or Appendix K of the

Guidelines for Research Involving Recombinant DNA

Molecules (NIH Guidelines) June 1994, published in the

Federal Register by the U.S. Department of Health and

Human Services, 59 FR 34472 (July 5, 1994), as amended

from time to time, and which are required based on the

risk group classification of the living organism;
