PR EFACE
To the Fifth Edition
There have been many signif‌ica nt developments in Charter juri spru-
dence since the publication of the fourth edition four years ago. The
Supreme Court has revisited fund amental issues concerning the inter-
pretation of freedom of association; equal ity rights; and the reach of the
protection accorded life, liberty, and security of the person. There have
also been signi f‌icant developments with regard to freedom of expres -
sion, freedom of religion and its relationship with t he fair trial rights of
the accused. The Supreme Court has also c larif‌ied the test for awarding
damages under section 24(1) of the Charter. We have done our best to
ref‌lect these and other developments in thi s edition.
